For two decades, Angels In Waiting has recruited hundreds of nurses-foster parents and saved countless childhoods. AIW created a California state law protecting our growing medically fragile foster care population. Numerous miracles have occurred through the hearts and hands of our devoted nurses. Sammy, the founder's son, a 23-week gestational age preemie who is now 17 years of age, has inspired our charity to help him in creating a new state law. This law gives women more options and helps protect potentially viable fetuses who are about to be abort under California state law. Sammy's Bill will provide women a 3rd Option. Babies at 24+ weeks gestational age with the aid of our neonatal intensive care units and advancement in neonatal medicine have a 75%+ survival rate. Recent studies have also shown that with proper care, the majority of 24-week neonates will have minimal to no neurological and or physical complications by their second birthday. The Issue

CDC reported a total of 862K abortions for 2017. 1.3% of abortions were equal to or greater than 20 weeks gestation. The cut-off age for abortion in California is 24-weeks gestational age. Recent scientific studies are showing a 75% survival rate with 24-week fetuses; most experience mild to no neurological and developmental issues by their second birthday. These positive outcomes are primarily due to recent advancements in neonatal intensive care and neonatal science. As a result of these new advancements, many 24-week fetuses chosen for abortions are potentially viable fetuses by today's medical standards. Moreover, studies show many women who experience late-term abortions suffer from emotional distress and conflict for many decades, if not for their lifetime.

Existing Law

The Supreme Court does not define viability because they say the point of viability varies. The court ruled; viability could only be determined on a case-by-case basis and by the woman's doctor. The same doctor who, due to state abortion laws, may not have the ability to perform an ultrasound to assess accurate fetal viability and a more exact gestational age.

With this Bill and your help, women would have an additional option for themselves and their potentially viable fetuses.Sammy’s Bill would like to provide women the ability to induce labor via pre-term induction procedures with fetal-safeguarding protocols. A pre-term induction procedure ends her pregnancy but does not terminate the life of her potentially viable fetus. Sammy’s Bill would create a state law allowing women an additional choice as well as an alternative option, where women can request a pre-term induction procedure versus a dilation and evacuation procedure if the fetus is deemed potentially viable by her doctor. Furthermore, hospitals with neonatal intensive care units throughout California are already successfully saving "wanted" 24-week and older fetuses by utilizing the same pre-term induction protocols. These safer protocols were established due to the plethora of complications that compromised the mothers' and fetuses' welfare during late-term pregnancies.

Life, Liberty, and the pursuit of Happiness is a famous phrase in the United States Declaration of Independence and is the bedrock of our American values. We hold these truths to be sacred and indisputable; that all men are created equal and independent.

We Americans derive rights inherent and inalienable, among which are the preservation of life. When a woman requests to terminate her late-term pregnancy but not the life of her potentially viable fetus, Sammy's Bill offers another option that utilizes a standardized pre-term induction procedure that could possibly save the life of her fetus. We believe women who are aborting their late-term fetuses need more options and choices. Potentially viable fetuses of 24-weeks gestational age and higher could also have these inherent rights if their mothers choose that for them. Sammy's Bill wants to create more alternative options, preserving the mother's long-term emotional and psychological wellbeing by helping to maintain the life of her potentially viable fetus and giving her the opportunity of not having to pay for it or raise the infant. Our limited state abortion laws currently permit a woman to terminate her late-term pregnancy, along with the life of her potentially viable fetus. Our goal is to implement a state law that provides a woman with a third option. Sammy's Bill would allow her to end her pregnancy but not end the life of her potentially viable fetus, keeping her viable infant alive, but not raise it. Sammy's Bill gives women more choices, diminishing her emotional trauma, all while offering a potentially viable fetus a fighting chance at life.
